Data Processing Agreement
For customers who require a DPA alongside our standard terms.
When you contract Linusite to handle personal data on your behalf, this Data Processing Agreement ("DPA") applies in addition to our Terms & Conditions.
1. Roles
You are the Data Controller. Linusite is the Data Processor, acting only on your documented instructions.
2. Subject matter, duration, nature, purpose
We process personal data for the duration and purpose of the services you've engaged us for — typically: development, hosting, email, CRM, support and analytics on systems we operate for you.
3. Categories of data
Personal data may include: names, email addresses, phone numbers, account details, content uploaded by your users, and technical identifiers (IP, device).
4. Security
We apply reasonable, industry-standard technical and organisational measures: encryption in transit and at rest, role-based access, audit logs, daily backups to off-site storage, and a documented incident-response process.
5. Sub-processors
We use a small set of sub-processors to deliver the service — including our hosting provider, email infrastructure, payment gateway and analytics. The current list is available on request. We'll notify you of changes before they take effect.
6. Cross-border transfers
Because we operate in Namibia and the US, personal data may be transferred between these jurisdictions, with appropriate safeguards (Standard Contractual Clauses where applicable).
7. Data subject rights
On request, we'll assist you in fulfilling data-subject rights — access, correction, deletion, portability — within a reasonable timeframe.
8. Breach notification
We'll notify you without undue delay (and in any case within 72 hours of detection) of any personal-data breach affecting your data.
9. Audits
On reasonable notice, you may audit our compliance with this DPA — either remotely or via a mutually agreed third-party auditor.
10. Termination
On termination, we will delete or return personal data within 30 days, except where retention is required by law.
